Terms and conditions

Article 1 – Definitions The following definitions apply in these terms and conditions:

1.1 Ilona's Boutique: a private limited company registered in the Netherlands under number 85727873 with the Chamber of Commerce, VAT number NL004136458B66, trading under the name Ilona's Boutique.

1.2 Consumer: a natural person who is not acting in the course of a trade, business or profession and who enters into a distance contract with Ilona's Boutique.

1.3 Distance contract: a contract concluded between Ilona's Boutique and the Consumer under an organised distance sales system without simultaneous personal presence.

1.4 Contract withdrawal period: the period during which the Consumer may exercise their right to withdraw from the contract.

1.5 Right to withdraw from the contract: the possibility for the Consumer to withdraw from a distance contract during the contract withdrawal period.

1.6 Day: calendar day.

1.7 Durable medium: any device that enables the Consumer or entrepreneur to store information in a way that allows future viewing or use for a period of time appropriate to the purpose of the information.

Article 3 – Application

3.1 These terms and conditions apply to every offer made by Ilona's Boutique and to every distance contract concluded between Ilona's Boutique and the Consumer.

3.2 Before the distance contract is concluded, the text of these terms and conditions will be made available to the Consumer.

3.3 If the distance contract is concluded electronically, the text may be provided electronically in such a way that the Consumer can easily store it on a durable medium.

Article 4 – Offer

4.1 If the offer is limited in time or subject to conditions, this will be explicitly stated in the offer.

4.2 The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the Consumer to make a proper assessment.

4.3 All photographs, specifications and data included in the offer are indicative and cannot give rise to compensation or termination of the contract.

Article 5 – Contract

5.1 Subject to the provisions of paragraph 4, the contract is concluded at the moment the Consumer accepts the offer and meets the specified conditions.

5.2 If the Consumer has accepted the offer electronically, Ilona's Boutique will immediately confirm receipt of the acceptance of the offer.

5.3 If the contract has been concluded electronically, Ilona's Boutique will take appropriate technical and organisational measures to secure the electronic transfer of data and ensure a secure online environment.

Article 6 – Right to withdraw from the contract

6.1 The Consumer has the right to withdraw from the contract within 30 days without giving any reason.

6.2 The withdrawal period expires after 30 days from the day on which the Consumer or a third party designated by the Consumer, other than the carrier, took physical possession of the goods.

6.3 The right to withdraw from the contract does not apply to:

a) products made to the Consumer's specifications or clearly personalised;

b) sealed goods which are not suitable for return due to health protection or hygiene reasons, if they have been unsealed after delivery.

Article 7 – Consumer's obligations during the withdrawal period

7.1 During the withdrawal period, the Consumer should handle the product and packaging with care. The product should only be unpacked or used to the extent necessary to determine its nature, characteristics and functioning.

7.2 If the Consumer exercises their right of withdrawal, they should return the product with all accessories supplied, in its original condition and packaging, in accordance with Ilona's Boutique's reasonable instructions.

Article 8 – Exercising the right to withdraw from the contract

8.1 To exercise the right to withdraw from the contract, the Consumer must inform Ilona's Boutique in an unambiguous manner (e.g. in writing or by e-mail).

8.2 The Consumer shall return the product within 30 days of such notification.

8.3 The Consumer shall bear the direct costs of returning the goods.

Article 9 – Obligations of Ilona's Boutique in the event of withdrawal from the contract

9.1 If the Consumer withdraws from the contract, Ilona's Boutique shall refund all payments received from the Consumer, including delivery costs, without undue delay, no later than 30 days from the notification of the Consumer's decision to withdraw from the contract.

9.2 Ilona's Boutique will use the same means of payment as the Consumer used for the original transaction, unless expressly agreed otherwise.

9.3 Ilona's Boutique may withhold the refund until it has received the goods or until the Consumer has provided proof of return, whichever occurs first.

Article 10 – Price

10.1 The prices of the products and/or services offered will not be increased during the period of validity of the offer, except for price changes caused by changes in VAT rates or exchange rate fluctuations.

10.2 All prices include VAT, unless expressly stated otherwise.

10.3 Any additional delivery costs or other costs will be clearly stated before the Consumer places an order.

Article 11 – Performance and warranty

11.1 Ilona's Boutique guarantees that the products and/or services comply with the contract, the specifications in the offer, reasonable requirements for reliability and usability, and the applicable laws and/or government regulations in force on the date of the contract.

11.2 Any warranty provided by Ilona's Boutique, the manufacturer or the importer does not affect the Consumer's rights and claims under the contract.

Article 12 – Delivery and fulfilment

12.1 Ilona's Boutique will make every effort to accept and fulfil orders for products.

12.2 The place of delivery is the address provided by the Consumer to Ilona's Boutique.

12.3 Ilona's Boutique will fulfil accepted orders within a reasonable time, no later than within 30 days, unless another delivery date has been agreed.

12.4 In the event of a delay in delivery or inability to fulfil the order or only partial fulfilment of the order, the Consumer will be informed of this no later than 30 days after placing the order.

12.5 In such cases, the Consumer has the right to terminate the contract free of charge and is entitled to a refund, if applicable.

Article 13 – Payment

13.1 Unless otherwise agreed, amounts due from the Consumer must be paid within 14 days of the start of the withdrawal period or, in the absence of a withdrawal period, within 14 days of the conclusion of the contract.

13.2 The Consumer is obliged to immediately report any inaccuracies in the payment details provided or indicated to Ilona's Boutique.

Article 15 – Disputes

15.1 Contracts concluded between Ilona's Boutique and the Consumer to which these terms and conditions apply are governed by hungarian law.

15.2 Any disputes arising from these terms and conditions shall be settled by the competent common courts in hungary.

Article 16 – Additional provisions or provisions deviating from these terms and conditions 16.1 Additional provisions or provisions deviating from these general terms and conditions may not be disadvantageous to the Consumer and must be made in writing or in such a way that the Consumer can save them in an accessible manner on a durable data carrier.

Article 17 – Intellectual property

17.1 All intellectual property rights relating to products, brand names, designs, texts, images and other materials belong to Ilona's Boutique or its licensors.

17.2 The Consumer may not copy, publish, reproduce or otherwise use the materials referred to in Article 17.1 without the prior written consent of Ilona's Boutique.

Article 18 – Force majeure

18.1 Ilona's Boutique shall not be liable for any failure or delay in the performance of its obligations under the contract due to circumstances beyond its reasonable control, including, but not limited to, natural disasters, war, terrorism, strikes, pandemics, government restrictions or telecommunications network failures.

18.2 During the period of force majeure, Ilona's Boutique may suspend the performance of its obligations under the contract. If this period lasts longer than 30 days, either party may terminate the contract without being liable for compensation.
